These User Terms & Conditions ("Terms") govern the access to and use of the mobile application and related digital platform branded as "Dryber" ("Platform"), operated by Dryber Technologies Private Limited, a company incorporated in India ("Company", "Dryber", "we", "us", or "our").
By accessing, registering on, or using the Platform, or by clicking "I Agree", you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with these Terms, you should not access or use the Platform.
1.1 For the purposes of these Terms, "User" means any individual or entity accessing or using the Platform, "Driver" means an independent driver made available through the Platform, "Service" means the facilitation of connecting Users with Drivers through the Platform, and "Booking" means a request placed by a User through the Platform.
1.2 Headings are inserted for convenience only and shall not affect the interpretation of these Terms.
2.1 To register and use the Platform, a User must be at least eighteen (18) years of age and legally competent to enter into a binding contract under applicable Indian law.
2.2 Bookings may be made on behalf of minors by a parent or legal guardian using their own account. In such cases, Dryber may implement additional safety and monitoring measures through the Platform, including recommendations for pre-approved routes or stops, enhanced visibility of trip details, and notifications to Drivers to exercise additional caution.
2.3 Where a Booking is made for a minor, only pre-approved stops may be permitted and deviations may be flagged by the Platform. Notwithstanding any safety measures implemented, the parent or legal guardian shall remain fully responsible for the Booking and for any consequences arising from it.
2.4 The Platform may be used by individual users as well as corporate or business users. Use of the Platform is restricted to India.
3.1 Dryber operates solely as a technology-enabled intermediary that facilitates connections between Users and independent Drivers.
3.2 Dryber does not provide transportation services, does not own or operate any vehicle, does not employ Drivers, and does not control or supervise how any service is performed.
3.3 No agency, partnership, joint venture, or employer-employee relationship is created between Dryber and any Driver as a result of the use of the Platform.
4.1 The Platform enables Users to request Drivers exclusively for the purpose of driving the User's own vehicle.
4.2 Services are available only for cars. Two-wheelers are not supported on the Platform.
4.3 Both private and commercial vehicles may be used, subject to compliance with applicable laws and regulations.
4.4 Bookings must be placed at least 1 hour in advance and may also be scheduled for a later date or time. Dryber does not guarantee that a Driver will always be available for every Booking request.
5.1 Users are responsible for maintaining the confidentiality of their account credentials and for all activities carried out through their account.
5.2 Users shall ensure that all information provided during registration and use of the Platform is accurate, complete, and kept up to date.
6.1 By placing a Booking, the User confirms that they have lawful ownership of, or valid authority to use, the vehicle.
6.2 The User further confirms that the vehicle is validly registered, insured as required by law, and maintained in a roadworthy and safe condition.
6.3 Dryber reserves the right to deny, cancel, or discontinue a Service if the vehicle appears unsafe, unfit for use, or non-compliant with legal requirements.
7.1 A Booking may be cancelled by the User at any time; however, cancellation charges may apply depending on the status of the Booking.
7.2 No cancellation charge shall apply if the Driver has not commenced movement towards the pickup location.
7.3 If the Driver has begun traveling towards the pickup location, a cancellation charge of thirty percent (30%) of the applicable amount may be levied.
7.4 If the Driver has reached or is in close proximity to the pickup location, a cancellation charge of fifty percent (50%) of the applicable amount may be levied.
7.5 Cancellation charges, where applicable, shall be determined by Dryber based on operational considerations such as time, distance, and prevailing circumstances, including weather conditions.
7.6 There is no maximum booking duration. However, a minimum booking duration of 1 hour shall apply.
7.7 If the Service continues beyond the originally booked duration, such additional time shall be treated as overtime and shall be chargeable accordingly, as determined by Dryber and displayed or communicated through the Platform.
8.1 Prices displayed on the Platform are calculated using standardized parameters and remain fixed unless there is a change in trip details. Pricing may vary based on factors such as time and distance.
8.2 All payments are made directly by the User to the Driver. Dryber does not collect, hold, or process payments from Users.
8.3 Users are encouraged to make online payments for improved transparency, security, and record-keeping. Cash payments may also be made at the User's discretion.
8.4 Any payment-related dispute is primarily between the User and the Driver. Where reasonably necessary, Dryber may facilitate communication or assist in resolution, without assuming any payment or financial liability.
9.1 Users shall conduct themselves in a respectful, lawful, and responsible manner while using the Platform and during the Service.
9.2 Any form of abuse, harassment, threats, violence, possession or use of illegal substances, or conduct that compromises safety or legality is strictly prohibited.
9.3 Intoxication by itself does not constitute a violation of these Terms; however, any behaviour that endangers safety, disrupts the Service, or violates applicable law is not permitted.
9.4 Misuse of the Platform or the vehicle, or engagement in unlawful activities, may result in suspension or permanent termination of the User's account.
10.1 Dryber does not guarantee safety outcomes and does not control real-world interactions between Users and Drivers.
10.2 Users are responsible for exercising reasonable judgment and taking appropriate precautions while availing the Service.
11.1 Users may provide ratings and reviews for Drivers through the Platform.
11.2 Dryber reserves the right to moderate, remove, or hide reviews that are misleading, abusive, or otherwise inappropriate.
11.3 Feedback shared by Users may be used by Dryber for service improvement and related communications.
11.4 Communications facilitated through the Platform may be logged or recorded for safety, quality control, and dispute resolution purposes.
12.1 Dryber may suspend or terminate a User's account for cause, including violation of these Terms or applicable law.
12.2 Upon termination, the User may be restricted from creating a new account on the Platform.
13.1 Use of the Platform is subject to Dryber's Privacy Policy, which forms an integral part of these Terms.
13.2 Dryber does not intentionally collect biometric data, health data, or financial account credentials.
13.3 By using the Platform or clicking "I Agree", the User consents to the collection and processing of data as described in the Privacy Policy.
14.1 Dryber does not provide any insurance coverage.
14.2 Any incident, loss, or damage arising during the Service shall be addressed under the applicable insurance of the User or the responsible party.
14.3 Dryber shall not be liable for vehicle damage, personal injury, loss of belongings, or third-party claims. Dryber's role is strictly limited to that of an intermediary.
The User agrees to indemnify and hold harmless Dryber against any claims, losses, liabilities, or expenses arising from misuse of the Platform, violation of these Terms, or breach of applicable law.
All intellectual property rights in the Platform vest with Dryber. Users are granted a limited, non-transferable, revocable license to use the Platform for lawful purposes. Any unauthorized copying, reverse engineering, scraping, or misuse is prohibited.
Dryber shall not be liable for any failure or delay in performance resulting from events beyond its reasonable control.
Dryber may revise or update these Terms from time to time. Continued use of the Platform after such updates constitutes acceptance of the revised Terms.
19.1 These Terms shall be governed by and construed in accordance with the laws of India.
19.2 The Parties shall first attempt to resolve disputes amicably.
19.3 If unresolved, disputes shall be referred to arbitration. The arbitrator shall initially be appointed by Dryber, with a reasonable opportunity for change upon valid objection by the User. The seat of arbitration shall be from that location where booking is done and the language shall be as mutually preferred by the Parties.
19.4 Court proceedings shall be limited to urgent or injunctive relief. Courts at booking location shall have jurisdiction.
20.1 If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall continue in full force.
20.2 These Terms, together with the Privacy Policy, constitute the entire agreement between the User and Dryber.
